Terms of Service

By accessing or using WizPrep AI (the "Service") at wizprep.ai, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. You are responsible for compliance with local laws that apply to you. The Service provides educational tools and AI-generated feedback for TOEFL preparation and is offered for general information and study support only.

You must be at least 13 (or the minimum age in your jurisdiction) and able to enter a contract. When you create an account, you must provide accurate information and keep your credentials secure. You're responsible for all activity under your account and must notify us promptly of suspected unauthorized use: support@wizprep.ai.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial study during your active plan period. You may not:

• Modify, reproduce, distribute, publicly display, or create derivative works from our content except as allowed by these Terms;
• Reverse engineer or attempt to extract source code from any part of the Service;
• Remove proprietary notices or circumvent technical protections;
• "Mirror," frame, or scrape the Service or content.

If you breach these Terms, this license ends immediately and you must cease use and delete downloaded content derived from the Service.

The Service (including text, graphics, interfaces, code, models, and training pipelines) is owned by WizPrep AI and its licensors and is protected by intellectual-property laws. Except for the limited license above, no rights are granted.

You are responsible for all content you submit (e.g., essays, audio answers, profile info) and you represent you have necessary rights to submit it. To operate and improve the Service (e.g., generate feedback, provide analytics, detect abuse), you grant us a worldwide, royalty-free, non-exclusive license to host, process, transform, display, and analyze your submitted content, solely in connection with the Service and our internal model/service improvement. You may delete your content via account tools where available; backups or aggregated/anonymized data may persist for a reasonable period.

You may not use the Service to:

• Violate laws or infringe rights; engage in fraud, malware, or security breaches;
• Exploit or harm minors; upload unlawful, obscene, or harassing content;
• Attempt to bypass usage limits, rate limits, or access controls;
• Interfere with the Service's operation or other users' enjoyment;
• Train competing models or build a substantially similar competing service without written permission.

AI feedback can be imperfect and may contain errors. The Service is study support, not official ETS/TOEFL scoring or professional advice. Always review results critically and use your judgment.

The Service may link to or rely on third-party services (e.g., payment processors, analytics). We do not control third-party sites and are not responsible for their content or policies. Your use of third-party services may be subject to their terms.

Your use is subject to our Privacy Policy, which explains what we collect, how we use it, and your choices.

We may modify or discontinue features. Where changes materially affect your paid access, we'll provide notice (e.g., in-app or email) and, where applicable, options consistent with our Refund/Cancellation Policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. We do not warrant that the Service will be uninterrupted, accurate, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, WIZPREP AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, OR GOODWILL; OR SERVICE INTERRUPTION OR SYSTEM FAILURE, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability for any claim will not exceed the amount you paid to us for the Service in the six (6) months before the event giving rise to liability.

You agree to indemnify and hold harmless WizPrep AI and its operators from claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from (a) your content, (b) your misuse of the Service, or (c) your violation of these Terms or applicable law; except to the extent caused by our intentional misconduct or gross negligence.

You agree to pay the fees shown at checkout for your subscription and/or credit bundles (e.g., speaking/writing credits). Payments are processed by third-party processors (e.g., Stripe). Taxes (VAT/GST/sales tax) may apply based on your location and will be shown at checkout.

• Auto-renewal: Subscriptions renew automatically unless canceled.
• Credits: Purchased credits are usable as described at purchase. Promotional or gifted credits may have different expirations as stated in the offer.
• No physical goods: Unless expressly stated, we sell digital services only.
• Billing issues: Contact support@wizprep.ai before initiating a chargeback—we can usually resolve issues quickly.

Cancellations: You can cancel future renewals at any time via Settings → Billing or by emailing support@wizprep.ai from your account email. Cancellation takes effect at the end of your current billing period.

Refunds: Our detailed Refund Policy applies (e.g., window for first-time purchase refunds on unused subscriptions/credits, whether pro-rata applies, and exclusions).

Your access lasts for the plan period shown at purchase or in your account. Some features (e.g., high-volume grading) may be metered or subject to fair-use limits that we publish or communicate from time to time.

You may stop using the Service at any time. We may suspend or terminate access for material breach, unlawful activity, non-payment, or risks to the Service or users. Where reasonable, we'll notify you and, if applicable, provide steps to cure.

We may update these Terms. Material changes will be posted with a new effective date and, where required, we'll notify you. Continued use after changes means you accept the new Terms.

Informal Resolution First. Before filing a claim, the party must email a Notice of Claim to the other at support@wizprep.ai, describing the claim and requested relief. The parties will discuss in good faith (video/phone) within 30 days.
